This Privacy Policy explains how EverRaise, Inc. ("EverRaise," "we," "our," or "us") collects, uses, discloses, and protects personal information when you ("User," "You," or "Your") access or use the EverRaise platform, applications, websites, and related services (collectively, the "Platform").

By using the Platform, you consent to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide Directly

We collect information that you voluntarily provide, including:

  • Account information (name, email, password, organization details)

  • Billing and payment information

  • Contact lists uploaded by User (donors, supporters, customers, constituents, volunteers, etc.)

  • Call scripts, messages, campaign content, and AI prompts

  • Preferences, settings, and communication opt-in information

  • Customer support requests and messages

1.2 Automatically Collected Information

When you use the Platform, we may automatically collect:

  • IP address, browser type, device identifiers

  • Usage logs, metadata, timestamps

  • Pages viewed, clicks, and actions taken

  • Authentication logs for security and fraud prevention

1.3 Telephony and Messaging Data

Through integrations with third-party providers (such as Twilio), we may collect:

  • Phone numbers

  • Call detail records (CDRs)

  • Call duration, connection status, and routing data

  • Text message metadata and delivery reports

  • Carrier filtering or blocking results

  • Call recordings (if User enables recording)

  • AI-generated transcripts of calls

1.4 AI Interaction Data

To generate and improve AI-based services, we may collect:

  • Text prompts and voice prompts you submit

  • AI-generated outputs

  • Logs needed to monitor model performance, prevent abuse, and ensure safety

We do not use User data to train public AI models.

1.5 Cookies and Tracking Technologies

We may use cookies, web beacons, and analytics tools to improve Platform functionality and performance.

You may adjust cookie settings through your browser.

2. How We Use Information

We use personal information to:

  • Provide, operate, and improve the Platform

  • Authenticate your identity and secure your account

  • Deliver voice calls, SMS messages, and emails that you initiate

  • Generate AI scripts, content, and automations

  • Ensure compliance with telephony, carrier, and regulatory requirements

  • Provide customer support and resolve issues

  • Process payments and manage billing

  • Prevent fraud, misuse, and unauthorized activity

  • Analyze usage patterns and improve product performance

  • Communicate service announcements and updates

We do not sell or rent User contact lists or personal data.

3. User Ownership of Contact Data

You retain ownership and control of all contact lists, donor data, supporter information, and personal information uploaded to the Platform.

EverRaise will not:

  • Sell, rent, or repurpose your contact data

  • Contact your donors, supporters, or customers for our own benefit

We will only process User contact data as needed to:

  • Deliver communications you initiate

  • Provide service functionality

  • Support carrier and compliance requirements

  • Improve Platform security and reliability

4. Legal Basis for Processing

Where required by law (such as GDPR-aligned jurisdictions), we process data under:

  • Contract necessity

  • Legitimate interest

  • User consent

  • Legal obligation

5. Sharing of Information

We do not sell your personal information. We may share your information in the following circumstances:

5.1 Service Providers

We may share information with service providers that help us operate the Platform, including:

  • Telephony providers such as Twilio

  • Hosting and infrastructure providers

  • AI model providers

  • Email and SMS gateways

  • Payment processors

  • Analytics tools

Service providers may only access data as needed to perform services for EverRaise.

5.2 Compliance and Legal Requirements

We may disclose information if required by:

  • Law, regulation, or legal process

  • Subpoena or court order

  • Government inquiries or investigations

We may also disclose information when necessary to:

  • Enforce the Terms of Service

  • Prevent fraud or abuse

  • Protect EverRaise, its Users, or the public

5.3 Business Transactions

If EverRaise merges, acquires, or sells assets, User data may be transferred as part of the transaction.

6. Prohibited Sensitive Data

Users may not upload or transmit the following without written permission:

  • Social Security numbers

  • Financial account or credit card numbers

  • Medical or health data (PHI)

  • Government IDs

  • Biometric identifiers

  • Data classified as sensitive under applicable privacy laws

Uploading restricted data is a violation of the Terms of Service.

7. Data Security

We implement technical and organizational measures to protect information, including:

  • Encryption in transit and at rest

  • Access controls

  • Authentication and authorization systems

  • Secure data center hosting

  • Logging and monitoring

While we strive to protect data, no system is completely secure.

8. Data Retention

We retain personal information for as long as necessary to:

  • Provide the Platform

  • Fulfill legal and regulatory obligations

  • Maintain business records

  • Resolve disputes

Users may request deletion of certain data, subject to legal requirements.

9. User Responsibilities

Users are solely responsible for:

  • Obtaining all required consents for storing and contacting individuals

  • Handling opt-out requests and unsubscribe requirements

  • Ensuring compliance with TCPA, TSR, 10DLC/A2P, charitable solicitation rules, and privacy laws

  • Ensuring the legality of all communications, scripts, and contact lists

EverRaise does not provide legal advice.

10. Call Recording and AI Voice Compliance

If User enables call recording or AI voice functionality:

  • User must comply with federal and state call recording laws

  • User must obtain all legally required disclosures and permissions

  • User must comply with any AI voice disclosure requirements

EverRaise is not responsible for violations related to recording or AI usage.

11. International Transfers

If you access the Platform outside the United States, your information may be transferred and processed in the U.S.

Appropriate safeguards are applied in accordance with applicable data protection laws.

12. Children's Privacy

The Platform is not intended for individuals under 16. We do not knowingly collect personal data from children under 16.

If such data is discovered, we will delete it promptly.

13. Your Privacy Rights

Depending on your jurisdiction, you may have rights to:

  • Access personal information

  • Correct inaccuracies

  • Request deletion

  • Restrict or object to processing

  • Request a copy of your data

  • Opt out of data sale or sharing (EverRaise does not sell data)

  • Appeal denied privacy requests
